In accordance with the Personal Data Protection Law No. 6698 (“Law”) published in the Official Gazette dated 07.04.2016 and numbered 29677, LKH OTELCİLİK TURİZM SANAYİ VE TİCARET LİMİTED ŞİRKETİ/ LKH OTELCİLİK TURİZM SANAYİ VE TİCARET LİMİTED ŞİRKETİ/LKH HOSPITALITY TOURISM INDUSTRY AND TRADE LIMITED COMPANY (“Company”), acting as the “data controller,” hereby provides the following information to its users and customers with this Information Notice in order to fulfill the notification obligation arising from Article 10 of the Law. This Information Notice is valid for all personal data provided by users and customers to the Company when visiting the website named (“Site”) and/or requesting services from hotels owned by our Company. Notification by the Data Controller The data you provide, such as your name, surname, email address, phone number, and data required during the Covid-19 period when making a reservation through the website, are stored and processed by the Company as the data controller. The Company places great importance on the privacy and protection of your personal data while providing its services. Therefore, the personal data obtained or to be obtained by the Company as the Data Controller, or shared by you with the Company, will only be processed by the Company within the scope and in the manner described below and as prescribed by the Law.


Method of Collecting and Processing Your Personal Data The Company’s website, social media accounts, mobile applications, sales and marketing units, customer forms, digital marketing channels, contracts, applications, forms, offers, and cookies used during “site” visits over the internet can collect your personal data in accordance with the Law, orally, in writing, or in electronic media. As the data controller, the Company, as written, oral, or electronic, or through websites, obtained personal data within the scope of the Law and other legislation; it can be recorded, stored, retained, modified, shared with third parties both in Turkey and abroad, including data transfers abroad, as required by legal or statutory reasons or the actual requirements of the service provided by the Company and/or deemed appropriate by the Company.


Purposes and Legal Grounds for Processing Your Personal Data Your personal data is stored and processed by our Company as the data controller based on the legal grounds of “clearly stipulated in the laws” under Article 5/2.a of the Law and “processing of personal data of parties to a contract, provided that it is directly related to the conclusion or performance of the contract” under Article 5/2.c of the Law. In this context, your personal data is processed by our Company for the following purposes, within the framework of consumer relations between the parties, as prescribed by the Consumer Protection Law No. 6502, Turkish Commercial Code No. 6102, and the related regulations and communiqués, as well as the Tax Procedure Law No. 213, and in accordance with the requirements of the services offered by our Company. Your personal data may also be processed for the purpose of providing information to customers within the scope of campaigns and advantages with your explicit consent as defined under the Electronic Commerce Regulation No. 6563. Your personal data is processed based on the legal ground of “processing of personal data of parties to a contract, provided that it is directly related to the conclusion or performance of the contract” within the scope of services provided by our Company such as making a reservation, performing the services, ensuring the continuity and efficiency of these services, informing about changes in these services, or ensuring the effective communication with customers, or controlling and improving the systems where the services are provided and preventing the illegal use of the services, or other legitimate interests of our Company. Persons and/or Organizations to Which Your Personal Data May Be Transferred Your personal data shared with the Company may be transferred within the scope of the purposes stated in the Law and this Information Notice to persons/organizations to whom the Company is affiliated, domestic/foreign subsidiaries, third parties who provide services or collaborate with the Company to carry out its activities, individuals and organizations that are software program-service partners, banks for collection purposes and/or authorized institutions for collection, domestic/foreign organizations that are worked with for the purpose of carrying out activities, and other relevant third parties.

Cases Where the Company May Process Your Personal Data Without Your Explicit Consent According to the Law Under Article 5 of the Law, the Company may process your personal data without seeking your explicit consent in the following cases: When it is clearly stipulated in the laws, When it is necessary for the protection of life or bodily integrity of you or someone else who cannot express their consent due to actual impossibility or whose consent is not legally valid, When it is necessary for the performance or establishment of a contract, provided that it is directly related to the parties to the contract, When it is necessary for the Company to fulfill its legal obligations, When your personal data is made public by you, When it is necessary for the establishment, exercise, or protection of a right, When it is necessary for the legitimate interests of the Company, provided that it does not harm your fundamental rights and freedoms.


What Are Your Rights According to the Law? In accordance with Article 11 of the Law, you can apply to the Company to: Learn whether your personal data is processed, Request information if your personal data has been processed, Learn the purpose of processing your personal data and whether they are used in accordance with their purpose, Know the third parties in the country or abroad to whom your personal data is transferred, Request the correction of your personal data if it is incomplete or incorrectly processed, Request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law, Request the notification of the operations performed as a result of your requests made in accordance with subparagraphs (d) and (e) to third parties to whom your personal data have been transferred, Object to the occurrence of any result that is to your detriment by means of analysis of your personal data exclusively through automated systems, Request compensation for the damages you have suffered due to the unlawful processing of your personal data, You have these rights. You can use your rights under this article by personally applying to the Company’s headquarters address, provided that it is notarized, or through other methods to be announced by the Company after the methods determined by the Personal Data Protection Board are announced. The Company will respond to your request as soon as possible and within a maximum of thirty (30) days free of charge. However, if the requested operation also requires a separate cost, a fee will be charged according to the tariff determined by the Personal Data Protection Board.
