1. thelocalhouse.com.tr TERMS OF USE

These Terms of Use (“Terms”) shall apply to the User using the internet site with the domain name thelocalhouse.com.tr (“Internet Site”) owned by LKH OTELCİLİK TURİZM SANAYİ VE TİCARET LİMİTED ŞİRKETİ/ LKH Hospitality Tourism Industry and Trade Limited Company (“Company”).

All natural and legal persons who visit or use the Internet Site (“User”) acknowledge, by using this Internet Site, that they have read all of these Terms of Use, understood all of its content, accept the terms contained in these Terms of Use, and furthermore accept and undertake that they will not raise any objections or objections to these matters; thus, they are bound by these Terms of Use.

These Terms of Use are published on the Internet Site in a way that allows access for all natural and/or legal persons using the Internet Site; if the User does not accept the provisions in these Terms of Use, they must refrain from using the Internet Site.

The Company may unilaterally change these Terms of Use and the information and content on the Internet Site, by publishing it on the Internet Site, at any time, at its sole discretion, provided that it does not violate the current legislation. The Company may add new provisions to these Terms of Use and add any other provisions, terms, and regulations included in the Internet Site in the future by announcing them through the Internet Site. The changes to be made in the Terms of Use will be valid as of the moment they are announced on the relevant Internet Site. Unchanged provisions will continue to be in effect as they are.

2. Terms And Conditions Of Use Of The Internet Site And Obligations

2.1. During the use of the Internet Site, the User (“User”) agrees to act in accordance with these Terms of Use, the laws of the Republic of Turkey, all kinds of legislation in force, public order, and general moral and ethical rules in all transactions and correspondences carried out by the User during the use of the Internet Site, and accepts and undertakes that they are responsible for any transactions, actions, and behaviors they perform through the Internet Site.

2.2. The User cannot use the Internet Site in any way that disrupts public order, contradicts general morality, is disturbing to others, is illegal, or may harm the rights of others. In this context, the User undertakes to avoid transactions, actions, and behaviors that may damage the personal or commercial reputation of the Company and/or third-party individuals or legal entities, infringe upon personal rights, have illegal qualities, and may constitute a crime. The User acknowledges and agrees that they are solely responsible for the legal and criminal liability of all transactions they make through the Internet Site.

2.3. The User cannot engage in actions that prevent or complicate the use of the Internet Site by other Users and visitors, cannot force servers or databases with automatic programs, cannot lock or deceive them, cannot engage in deceptive and/or fraudulent behavior or attempts that may result in these qualities, and cannot engage in any actions that may constitute a crime. In the event of a violation of the provisions mentioned in this article, any legal, criminal, and administrative liability that may arise will belong to the User.

2.4. The User cannot partially or completely copy, modify, reproduce, distribute, share, and process any images, texts, videos, lists, catalogs, promotions, advertisements, information, content, design, code, and software, visual and audio images, and any information or content in the database located on the Internet Site, without limitation, cannot create any other content using them, cannot compile, cannot publish directly or indirectly on other platforms, cannot transfer to other databases, cannot be opened to access and use by third parties, and cannot engage in actions that will result in this, including linking to advertisements on the Internet Site.

2.5. Unauthorized use of the Internet Site, changing or damaging the Internet Site, using it without authorization, using it for reverse engineering purposes, attempting to break API protocols using any method, attempting to access the systems by interfering with the operation of the Internet Site, and/or similar actions are illegal and prohibited.

2.6. The User acknowledges that they are personally responsible for any damage, harm, breakdown, or any consequences that may occur in their software and operating systems due to the use of the Internet Site and therefore, they know that they cannot claim compensation or any other claims from the Company due to any damage they may incur.

2.7. The Company cannot make any guarantee or commitment to the User regarding the use of these Terms that any User will act in accordance with these Terms, and cannot be held responsible for any claims, damages, or demands that may arise from the use of the Internet Site.

2.8. The Internet Site and its content are provided “as is” and “as available.” The Company does not make any guarantees or commitments that the Internet Site will operate without errors or interruptions, nor does it have any responsibility for the suitability of the Internet Site, the inability of the User to achieve a certain result as a result of accessing or using the Internet Site.

2.9. The Company is not responsible for any other websites and portals accessed through links provided on the Internet Site, or for the content and services offered on these portals.

2.10. During access to the Internet Site, the User cannot use someone else’s IP address, email address, username, and other information, nor can they access or use confidential information of other Users without permission. Otherwise, they will be responsible for all legal, criminal, and administrative liability.

3. Intellectual Property Rights

3.1. The “The Local House” trademark and other trademarks and logos owned by the Company, the Internet Site named thelocalhouse.com.tr, interface, advertisement database, content database, design, text, image, HTML code, and other codes, limited to these, all elements, the design of the Internet Site, the software, and any other trademarks, logos, designs, commercial presentation forms, slogans, and all other content created or to be created by the Company are entirely the intellectual property rights of the Company. The Company does not allow the acquisition, processing, use, sharing, exhibition, reproduction, distribution, copying, use in any way, sharing with third parties for access and use, or any work that includes these elements in any form, including domain names, routing codes, keywords, or similar means, in any way, by anyone, in any way, in accordance with the aforementioned quality or any action that may result in this. In this context, the User undertakes not to violate the intellectual property rights of the Company in the activities they carry out through the Internet Site and not to engage in any behavior that may compromise the rights of the Company.

3.2. If the User violates this obligation for any reason, the Company may terminate the use of the Internet Site by the User, and the Internet Site may be prevented from being used by this User. In addition, the Company’s right to file lawsuits, complaints, follow-ups, and requests arising from the violation of the law and other regulations, including this article, is reserved; the User acknowledges that they will be personally responsible for any material or moral damage and demands arising from such uses.

4. Protection Of Personal Data

4.1. The User acknowledges that IP address, date/time information, which parts of the Internet Site are visited, information about the type of browser, domain type, cookie records, and other data related to the use of the Internet Site may be used by the Company in compliance with legal principles for the protection of the privacy of such data, may be recorded, stored, classified, preserved, shared, transferred, disclosed, and may be processed in other ways. The Company may process User data related to the use of the Internet Site, including but not limited to, to ensure User security, fulfill its obligations, carry out promotional and marketing activities, carry out informative communication activities, conduct profiling and statistical studies, offer offers and products tailored to individuals based on habits and preferences, manage request and complaint processes, conduct evaluations and research necessary to improve its own processes, create a database, and conduct market research, and may transfer to companies it cooperates with for these purposes, and in this case, User information may be processed by these companies for the purposes mentioned within the framework of legal principles.

4.2. In order to display personalized content to the User and to engage in online behavioral advertising and marketing activities, the Company may place small data files that enable the recording and collection of certain data through technical means (such as the number of pages viewed, visit duration, and target completion number) on the Internet Site. (Briefly “Cookies”) The User can remove or reject cookies; however, in this case, they may not be able to access all the functions of the Internet Site or their access may be limited.

5. Changes To The Terms Of Use

The Company may unilaterally change these Terms of Use at its sole discretion at any time, by publishing it on the Internet Site, provided that it does not violate the current legislation. The provisions changed in these Terms of Use will be valid as of the moment they are announced on the relevant Internet Site. The remaining provisions will continue to be in effect as they are.

6. Force Majeure

Natural disasters, bad weather conditions, war, fire, decisions taken by the government, infrastructure and internet breakdowns, improvements, updates or renewal work on the system, and similar unpredictable events beyond the control of the Company are considered as force majeure.

7. Miscellaneous Provisions

7.1. In case of any disputes that may arise between the parties for any reason, the User accepts, declares, and undertakes that the Company’s books and all kinds of records (including computer records, microfilm, and microfiche) will be valid and exclusive evidence, and this provision will be considered as an evidentiary contract within the meaning of Article 193 of the Turkish Code of Civil Procedure.

7.2. If any provision or provision of these Terms of Use is invalid or unenforceable for any reason, the other provisions and provisions will continue to be fully valid.

7.3. Disputes arising from the interpretation or application of these Terms of Use will be subject to the laws of the Republic of Turkey and other relevant legislation. In case of any disputes arising from the interpretation or application of these Terms of Use, the Istanbul (Çağlayan) Courts and Enforcement Offices will have jurisdiction.

7.4. The fact that the Company does not use any of the rights mentioned in these Terms of Use does not mean that it has waived that right or will prevent the use of that right in the future.

8. Effectıveness And Acceptance

These Terms of Use will come into effect as of the moment they are published on the Internet Site by the Company, and the changes to the Terms of Use will be binding on the User as they are announced on the Internet Site. By using the Internet Site, the User acknowledges that they have accepted these Terms of Use and any changes to the Terms of Use.
